In these Terms and Conditions, our customers are referred to as “Customers,” “Users,” “Members,” “Account Holders,” “Traders,” “he,” “she,” “them,” “it,” either in the plural or singular. Likewise, Hermesfx is referred to in this document as “Hermesfx,” “broker,” “brokerage service provider,” “trading platform,” “trading intermediary,” “we,” and “us.”
Conditions for the Provision of Brokerage Services
By using our services, including our facilities such as tools, resources, and features, you agree to comply with these Terms and Conditions. The provisions contained in these General Terms and Conditions are transparent and free from ambiguity. Each provision is legally binding and enforceable on the customer and Hermesfx as an agreement duly concluded between the parties. You are entitled to use our services and facilities provided that you have unconditionally agreed to these terms and conditions.
If you do not agree to the following terms and conditions, you have the right to stop using our services/facilities and disconnect from us. However, if you are interested in becoming a member, you should read the terms and conditions in full and proceed with the registration process. Please note that we reserve the right to change, supplement, or delete provisions in the General Terms and Conditions in whole or in part without prior notice.
Restricted Use of Our Platform
We operate and offer our services in several states, and our services are provided in strict accordance with the relevant laws of each country. In some states, the laws restrict users’ access to brokerage services in general or in particular. We cannot offer services in such states and are legally prevented from serving prospective clients from those states. Neither you nor anyone else can require us to provide our services in such states if the restriction came into effect after you registered with us.
If anyone from a Restricted Access Area uses our services in any way, including through virtual private networks, that person is solely responsible for their actions.
We accept both oral and documentary evidence to verify your identity. However, we reserve the right to request further documentation if necessary. Proof of identity may include utility bills, ID cards, passports, financial statements, etc.
Access to Information
We are a legitimate company providing brokerage services worldwide and facilitating CFD trading for global traders. To support our business, we have established a website containing professionally written, designed, and organized content in written, visual, and audio form. All or part of this content should always be understood as information only. Additionally, we may be prohibited by law from providing such information in certain areas. In such cases, we reserve the right to remove or restrict the information to comply with applicable laws.
Professional Advice
As mentioned, the content on our website is provided for informational purposes only. No one has the right or authority to interpret this information as “advice” or “financial advice.” It is incorrect to assume that the information constitutes advice, and any consequences arising from such assumptions will be the responsibility of the person who made them.
Intellectual Copyrights
All the information and resources we offer to our customers, such as tools, features, and services, are the exclusive property of Hermesfx. Our platform, services, and tools are protected by registered copyrights. Only Hermesfx is authorized to use them for personal or commercial purposes. No one else is authorized to sell, rent, or sublet these tools and services without our explicit permission. If a user uses them without permission, we reserve the right to take legal action and claim damages.
Third-Party Resources
While Hermesfx is at the forefront of providing brokerage services, our offerings are complemented by third-party resources. By agreeing to these Terms and Conditions, you also acknowledge that you may or may not use third-party resources. If you choose to use these resources, you do so at your own risk, and Hermesfx will not be held responsible for any losses, theft, or fraud that may occur while using third-party resources.
It is entirely up to you whether or not you wish to use third-party resources. Hermesfx does not force or persuade you to use them, as our services are limited to what we directly provide.
Cancellation of Guarantees
By law and normal business practices, we do not guarantee profits. Likewise, in the event of any loss, we cannot guarantee compensation.
Liability for Capital Losses
Our liability is limited and pertains only to the services we offer through our trading platform. Our services should not be construed as advice, as we are simply providers of information and services.
Immunity from Liability
No one is exempt from repercussions and disputes. This condition applies to both Hermesfx and the customer. Both parties are responsible for their own actions.
Provision for Security
We offer a password recovery option if you lose your login ID or password, or both. However, if you have disclosed your password to others, we cannot provide security. It is your responsibility to take the necessary steps to protect your account. We can assist by setting up a new password for you.
Risk Understanding
All businesses, including CFD trading, come with risks. While risks cannot be entirely eliminated, they can be minimized, and we are here to help you manage them.
End of Use
These Terms and Conditions require you not to allow anyone to use our facilities and services without our permission. We can only provide services to our registered members, not to third parties, agents, friends, or family members of registered members.
